MINISTRY OF EXTERNAL AFFAIRS (MEA) DOCUMENT ATTESTATION

The Ministry of External Affairs (MEA) Attestation and Apostle work has been outsourced with effect from March 1, 2012. As a result of the Outsourcing, no document from individuals is accepted by MEA Counter at CPV Division, Patiala House, and New Delhi. The original document is to be submitted directly to one of the Outsourced companies, CIAS collection and delivery center along with a photocopy of th document and a photocopy of the applicant’s passport

The Ministry of External Affairs (MEA)

All original documents requiring Attestation or Apostille by the Ministry of External Affairs, New Delhi, are required to be first authenticated/attested by the designated authorities/departments of the State Governments//Union Territory from where the documents were issued. MEA Attestation can only be done after the respective relevant state authority has attested a particular document.

We require MEA attestation to use the document or certificate within India and in foreign countries. The process of Attestation of certificates/documents from MEA can be done on all the Certificates/documents issued by Indian Authorities. The procedure is as follows-


STEP 1: AUTHENTICATION OF DOCUMENTS

NON-EDUCATIONAL DOCUMENTS

The documents (like birth or death certificates, marriage certificates, affidavits, driving licenses, etc.) are required to be first attested by the State Home Department of the issuing State/Union Territory. The authentication must be done with the name and designation seal as well as the seal of the Department.


EDUCATIONAL DOCUMENTS

The documents should be first attested by the State Education Department of the concerned State Government/Union Territory. The authentication must be done with the name and designation seal as well as the seal of the Department


COMMERCIAL DOCUMENTS

The documents are to be pre-authenticated by the respective Chambers of Commerce before these can be attested by the Ministry of External Affairs, New Delhi. The rubber stamp of the respective Chamber of Commerce must be affixed on each document along with the name & designation of authorized signatory.



STEP 2: ATTESTATION/LEGALIZATION OF
DOCUMENTS BY MEA

DOCUMENT AND CHARGES

The Ministry of External Affairs (MEA) attests /legalizes the documents only after these have been authenticated by the signature and seal/stamp of the designated authorities of the State Government/Union Territory/Chambers of Commerce from where the documents have been issued. The MEA legalizes the certificate/documents on the basis of the signature of the designated authorities; hence it does not take responsibility for the contents of the documents.


Types of Documents

The Ministry of External Affairs does not levy any fees for General Attestation of documents. However, it has fixed the following Service Charges payable to us for each document. The applicants need to submit the following documents/fees:

(a) Original document to be attested;
(b) One clear photocopy of the document;
(c) One clear photocopy of the passport;


MEA Apostle:-

The Hague Convention of October 1961 Abolished the Requirement of Legalization of foreign public documents. The Apostille Treaty is an international treaty drafted by the Hague Conference on Private International Law. Any document Apostilled in one member country is acceptable in all other member countries who are signatories to the Hague Convention. Apostille is affixed by competent authorities designated by the government of a country which is party to the convention. Apostille is done for personal documents like Birth, Marriage, Death Certificates, Affidavits, Educational documents like Degrees, Diplomas, Secondary level Certificates etc.

Apostille stamp is a square shaped computer generated sticker, pasted on reverse of the Original Documents by the MEA, India. MEA Apostille Stamp is a unique sticker having a unique identification number, through which any member country of The Hague convention can check its authenticity online. Under normal circumstances, once the document has been Apostilled by MEA, it does not need to be attested any more from the concerned foreign embassy.

The Ministry of External Affairs (MEA), Government of India has outsourced its Attestation and certificate Apostille work with effect from March 1, 2012. MEA is the sole authorized body having the authority to issue Apostille and authenticate the documents originated in India for use in foreign country. CIAS is one of the authorized outsourced companies for collection and delivery of documents on behalf of MEA to carry out further procedure of Apostille Attestation. As a result of Outsourcing, collection and delivery of documents are not accepted from individual applicants by CPV Division of the Ministry of External Affairs at Patiala House, New Delhi. All applicants are required to submit and collect their documents through the outsourced companies.


Certificate Apostille

All original documents/certificates requiring MEA to issue Apostille must be first authenticated by the designated authorities of the State/Union Territory from where the document is issued. Indian Apostille can only be issued by MEA when the respective relevant state authority has attested a particular document. Documents Apostille Stamp

Documents Apostille Stamp is a square-shaped sticker generated from a computer and pasted on reverse of the documents you wanted to apostille. This stamp is provided by the Ministery of External Affairs, Government of India. An apostille is a kind of attestation by which a document is legalized. It is a defined format that is acceptable in all nations that comes under the Hague Convention. So, in Document Apostille, a unique computer-generated stamp has a unique identification number. With this unique identification code, the member of the Hague Convention checks the authenticity of the document online. As soon as the document is apostille it does not require any attestation further from the designated embassy.


Degree Certificate Apostille

The Degree Certificate Apostille is a document legalization process that verifies the authenticity of the same. This document is valid internationally in the members of Hague Convention countries. It is an alternative to legalization by the Hague Convention of October 5, 1961. So, the apostille is the process of documents/certificate legalization which is done on the educational, personal and commercial. Certificate Apostille can only be done on the documents issued in their own country. It is only valid for the countries which are part of the Hague Convention. Procedure of Apostille

India became member of the Hague Convention in 2005 which abolished the requirement of legalization of public documents. In India, Ministry of External Affairs (MEA) undertakes both, Apostille attestation and general attestation of documents. The procedure is as follows-

Types of Documents

While no fee is levied by the Ministry of External Affairs for General Attestation, there is a fee of Rs.50/- (Rupees Fifty only) per document Apostille. The fee is to be paid by means of Indian Postal Orders payable in favor of Pay & Accounts Officer, Ministry of External Affairs, New Delhi. Service charge payable to CIAS is the same for both general attestation and apostille attestation.

Only Original documents duly authenticated by the designated authorities of the concerned State Governments are Apostilled by the Ministry of External Affairs. Apostille sticker is issued on the reverse side of the original document. The applicants need to submit the following documents

Before doing any act of notary, it is the duty of the notary to ensure that the proper stamp duty is paid, if not he may impound it under Section 33(1) of the Stamp Act. Apart from the regular Notary Stamps duty, the act of notary attracts additional stamp duty under Article 42 of Indian Stamp Act and Article 36 of Karnataka Stamp Act, which is Rs. 10/-.

The Section 139 of Code of Civil Procedure 1908 has an express provision, where any affidavit verified by notary is acceptable as evidence. Similarly, Section 297 of Code of Criminal Procedure provides for admission of affidavits verified by the notary.


Notary Seal

• His name,
• The name of the areas within which he has been appointed to exercise his functions,
• The registration number,
• The circumscription "NOTARY",
• The name of the government which appointed him.

The notary should use his office seal on every document. The Evidence Act also provides that the courts must take judicial notice of seal of the notary. In the absence of the seal of the notary, the document has no evidentiary value.


Functions of Notary

• To verify, authenticate, certify or attest the execution of any instrument. The word instrument is defined in the Act as every document by which any right or liability is or purports to be, created,transferred, modified, limited, extended, suspended, extinguished or recorded. So every document is not an instrument, unless it confers a right or records a liability.

‘Verify’ means checking with the facts and proof/evidence produced

‘Authenticate’ means, the notary has assured himself of the identity of the person who has signed the instrument as well as to the fact of execution.

‘Certify’ means to confirm through a formal statement that the instrument executed possesses certain qualifications or meeting the accepted minimum standards relevant to the contents of the same.

‘Attest’ means to affirm to be correct, true or bear witness of.

To administer oath to or take an affidavit from any person.

To translate and verify the translation, of any document from one language into another.

To act as commissioner, to record evidence in any civil or criminal trial if so directed by the court or authority

To act as arbitrator, mediator, or conciliator if so required.

To do any other act that may be prescribed.
